LICENSE AGREEMENT
Net.Dreams hereby grants to you, a paid-up, nontransferable (except as specified), non exclusive license to use the "Software" subject to this agreement. You may use one copy of the Software on a single computer at a single location. You may transfer the Software from one such computer to another that you operate provided that you do not use or permit the usage of the Software on more than one computer or computer terminal at a time. You may not copy or duplicate the Software, except as necessary solely for archival purposes, program error verification, or to replace defective storage media. You agree to retain the Software and all such copies in your possession. You may transfer the Software (together with all backup copies you have make) on a permanent basis to a third party so long as you retain no copies and the transferee agrees to be bound by the terms of the Agreement.
RESTRICTIONS
In no event shall the Software be altered, modified, adapted, translated, decompiled, disassembled or used in any form to create new software based on or derived from the Software or otherwise used to discover the source code for the Software. TERMINATION
This License is effective until terminated. You may terminate this License at any time by destroying the Software and all copies thereof. This License will terminate immediately without notice from Net.Dreams if you fail to comply with any provision of this License. Upon termination you must destroy the Software and all copies thereof or return them to Net.Dreams.
DISCLAIMER OF WARRANTY ON SOFTWARE
You expressly acknowledge and agree that use of the Software is at your sole risk. The Software and related documentation are provided "as is" and without warranty of any kind and Net.Dreams expressly disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Net.Dreams does not warrant that the functions contained in the Software will meet your requirements, or that the operation of the Software will be uninterrupted or error-free, or that defects in the Software will be corrected. Furthermore, Net.Dreams does not warrant or make any representations regarding the use or the results of the use of the Software or related documentation in terms of their correctness, accuracy, reliability, or otherwise. No oral or written information or advice given by Net.Dream shall create a warranty or in any way increase the scope of this warranty. Some states do not allow the exclusion of implied warranties, so the above exclusion my not apply to you.
LIMITATION OF LIABILITY
In no event will Net.Dreams be liable to you for any direct, indirect, special, incidental, or consequential damages (including but not limited to lost revenues, data, profits or savings) arising out of your use or inability to use the Software even if Net.Dreams has been advised of the possibility of such damages. In no event shall the liability of Net.Dreams arising from your use or inability to use the software exceed the fee paid by you for this License. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
COMPLETE AGREEMENT
This License constitutes the entire agreement between the parties with respect to the use of the Software and related documentation, and supersedes all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
